Whatever your opinion is of the Florida Family Law Reform Bills SB668/HB455 will be going to the Florida House for either a Veto or for approval. It’s an emotionally charged debate in Florida and The Senate approved the bill 24-14.
By this week, it will go to the House floor for a vote. Many Floridian’s who are divorcing here in Tampa, or who have been divorced and have been paying alimony or child support are wondering how this will effect their cases. It’s tough to say ahead of the final outcome but it’s fair to assume if the law passes, there will be many seeking the services of a divorce lawyer for modifications.
Modifications of Alimony, Child Support, Time Sharing
Currently in order to modify alimony, there must be a significant and substantial change in circumstances as explained on our website here. Same goes for child support and time sharing modifications. Florida law has been very clear about why, when and how you can petition the courts for modifications of support and alimony.
As far as the current alimony laws in Florida, there are different types of alimony and this is where the reform gets heated and emotionally charged. It can be very difficult to modify the alimony once it is awarded, and that goes for both parties, and depending on the length and type of marriage arrangement you and your spouse had, the courts currently have the option to award one of these types of alimony. If the Bill passes, this will change the landscape of how spouses will financially support themselves post divorce.
